1.1 Introduction These Official Rules of the Dacia Spring Electric Tournament with Rocket League (hereinafter the "Rules") govern all stages of the Dacia Spring Electric Tournament (hereinafter the "Tournament"), organised by RENAULT SAS, a simplified joint-stock company, with share capital of €533,941,113, having its registered office at 13 quai alphonse le gallo, 92100 BOULOGNE-BILLANCOURT, registered with the Nanterre Trade and Companies Register under number 780 129 987, represented by Mr Luca DE MEO, acting and having the necessary powers as President (hereinafter "Dacia"). Dacia can be contacted at the following address: Renault SAS, 13-15 quai le gallo 92100 BOULOGNE-BILLANCOURT These Rules have been established to preserve the integrity of the competitive position of the game Rocket League (the "Game") in connection with the Tournament. They are intended to promote vigorous competition and to ensure that each part of the Game played competitively is entertaining, lively and free of any Toxic Behaviour (as defined below). These Rules will be translated into other languages. In the event of any conflict or inconsistency between any translated version of these Rules and the French version, the French version shall prevail, shall govern the Tournament and shall be the preferred version. Participation in this Tournament shall not constitute participation in any other tournament, competition or contest or prize draw.
1.2 Acceptance To participate in the Tournament, each player must comply with these Rules in all circumstances, including the code of conduct described in Section 7 (the "Player"). Each Player must accept these Rules when completing the Tournament Entry Form, which is available at the following address: https://linktr.ee/daciaspringelectrictournament. By participating in a game of a Match within the Tournament, the Player confirms that they accept these Rules in accordance with Section 1.2.
1.3 Application Dacia assumes full responsibility for the application of these Rules for all Players participating in the Tournament, and may, in collaboration with the Tournament Administrators (as defined below), apply sanctions to Players in violation of these Rules, as described in Section 8.
1.4 Amendments From time to time, Dacia may update, review, change or amend these Rules. For each Player, participation in the Tournament will be deemed to be accepted after each notification to the Player on the email address they provided during the registration form of an update, revision, change or amendment of these undisputed Rules within 5 (five) days. In the absence of acceptance of these Rules, the Player may not participate in the Tournament.
2.1 Definition of the terms
Certain terms may come from the Game and refer directly to their definition given by the publisher of the Game and/or commonly accepted by the players of the Game. The following definitions shall also apply. ·
"Tournament Administrator": means any person designated by Dacia to administer, control and ensure good faith in the Tournament. ·
"Best of X games": means a Match consisting of X games and the Team that wins the majority of the games is declared the winner. Once the Team wins the number of games necessary to reach the required majority, said Team will be declared winner of the Match and any game that has not yet been played will not be played. For example, in a Best of three games match, once one of the Teams wins two games, said Team is immediately declared the winner of said match. · "Team": means a group of three (3) Players participating in the Team Tournament and meeting the conditions set out in Section 6. ·
"Identifier": means any element likely to identify a Player and/or a Team, whether it is a user name, an avatar including the image and/or logo and/or the brand of the Player and/or the Team, an online identifier, the name of a Player, the name of the Team, etc. ·
"Match": means an opposition during the Tournament between two Teams which may take place in several games, as described in Section
"Prize": means without distinction the prizes provided for in Section 4.1. ·
"Eligible regions": means France, Germany, Italy, Spain, Albania, Austria, Belgium, Bosnia and Herzegovina, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, Greece, Hungary, Iceland, Ireland, Latvia, Lithuania, Luxembourg, Macedonia, Malta, Moldova, Montenegro, Netherlands, Norway, Poland, Portugal, Romania, Serbia, Slovakia, Slovenia, Sweden, Switzerland, Turkey, United Kingdom.
2.2 Registration
Teams of 3 players minimum (it being specified that only 3 Players can play per game) can register for the Tournament from 03 March 2022 at: https://linktr.ee/daciaspringelectrictournament following the rules associated with the Toornament platform. Registration for each stage of the Open Qualification will end on the following dates and times:● 05 April 2022 at 6pm for the Open Qualification #1● 07 April 2022 at 6pm for the Open Qualification #2● 12 April 2022 at 6pm for the Open Qualification #3● 14 April 2022 at 6pm for the Open Qualification #4 No change in the Teams will be validated once the Open Qualification in which they have registered has begun. No registration will be accepted after 14 April 2022 at 6pm. 1.3
2.3 Program
The Tournament will include an "Open Qualification Stage" and a "Main Event" dual elimination table (as defined below). The schedule for each stage of the Tournament is detailed in this section.
2.3.1 Tournament dates

2.3.2 Rescheduling
Dacia may, in its sole discretion, rearrange the schedule and/or change the date of any Match or session associated with the Tournament (or change a game mode associated with it). Nevertheless, should the Tournament schedule change, Dacia will notify all Players as soon as practicable.
2.4 Tournament format and stages
2.4.1 Qualification stage:
Teams will first take part in an "Open qualification stage". Teams will be able to participate in several qualifying stages over four days of the Tournament. A team that loses a match in this stage will not be able to move on to the next stage. Leaders will be determined by Dacia and/or the Tournament Administrators at their sole discretion. The Matches of the qualification stages will take place as follows:
● Stages preceding the eighth final: Best of five games played in the following order: Dropshot, Rumble, Snow Day
● Eighth and Quarter-finals: Best of five games played in the following order: Dropshot, Rumble, Snow Day, Heatseeker, Dropshot
● Semifinal: Best of seven games played in the following order: Dropshot, Rumble, Snow Day, Heatseeker, Dropshot, Rumble, Snow Day The eight Final Teams will be qualified to participate in the "Main Event" (as defined below).
2.4.2 "Swiss round" Main event The "Main Event" is a "Swiss round" type stage of sixteen teams over one day (8 qualified during the "Open Qualification Stages" and 8 teams invited. All Games will take place as the Best of five games. A Team that loses three Games in this stage will not be able to move on to the next stage. Leaders will be determined by Dacia and/or Tournament Administrators at their sole discretion. During the main "Swiss round" event, each team will choose in turn the mode of play in which they will play in each round.
2.4.3 Main event dual elimination The "Main Event" is a double elimination board, consisting of two days of groups of 4 double elimination teams, then two days of final stages with the six qualified teams at the end of the group stages. During the group stages, a team is eliminated if it loses the semi-final of the lower part of the tournament tree. During the final stages, a team is eliminated if it loses a match from the lower part of the tournament tree, or the Grand Final. Leaders will be determined by Dacia and/or the Tournament Administrators at their sole discretion. All games will take place as Best of five games, with the exception of the losers' final, the winners' final and the Grand Final, all of which will take place as Best of seven games. In the Grand Final, the Team that lost a Game in the "Main event double elimination" will have to win two Games instead of just one to win the Tournament. During the Main Event double elimination, each Team will choose in turn the game mode in which they will play in each game. The winning team will be the one that wins the Grand Final.
This section details the "Game rules" that will be applied during the Tournament.
3.1 Match settings 1.1.1 Game settings

3.1.2 Controllers All standard controllers, including mouse and keyboard, are allowed. Macro functions (e.g. turbo buttons) are not allowed.
3.1.3 Arenas
All games will take place in the DFH Stadium or Core 707 for Dropshot mode during the qualification stage. During all other stages of the Tournament, the first game will take place in the DFH Stadium or Core 707 for Dropshot mode. All other subsequent Matches will take place in an eligible arena, chosen by the Tournament Administrators, at their sole discretion. "Main event" Teams may request to avoid an Eligible Arena due to performance issues by sending a detailed request to the Tournament Administrators no less than 24 hours prior to the start of the Game. The Tournament Administrators reserve the right to refuse for any reason, at their sole discretion, any request for change of arena made by the Teams. The following eligible arenas may be chosen:

3.1.4 Customisation of cars
From the "Main event dual elimination", Players will be required to equip their vehicle in the Game with one or more of the following customisation objects:
● Lightning Rocket trail
● Electroshock Goal Explosion
● Lightning Bolt Antenna
● Lightning Wheels
● Lightning Decal
● Or any other customisation object that represents electricity.
3.2 Match procedures
3.2.1 Organisation of the Teams' matches and colours
The Tournament Administrators will indicate which Team will play in blue and which one will play in orange. During the qualification stage, the Teams will receive instructions on how to organise the Matches. During all other stages of the Tournament, one of the Tournament Administrators will organise the Matches.
3.2.2 Rehosting
Between several games of the same Match, the Teams may request that the Match be rehosted in the same server region due to connection problems. At the "Main Event", the Teams may mutually agree to cancel the current game of the Match to rehost the Match with the agreement of the Tournament Administrators. The Tournament Administrators reserve the right to suspend and invalidate any Match game in progress for rehosting purposes, at any time.
3.2.3 Start of the game
Players do not have the right to join their respective camp until three Players from each of the Teams have joined the game.
3.2.4 Replacements
A "Replacement" is defined as a change of Player within the same Team once the Match has started. Replacements can only be made between the games of a Match and Teams are limited to one change of Player per Match. Replacements are not allowed during qualification stages unless there has been a disconnection.
3.2.5 Communication of scores
During the qualification stage, once the Match is over, the winning Team must communicate the result of the Match to the Tournament Administrators in a designated chat room. The losing team must also confirm the result of the match. Taking a screen shot of the results screen or saving the Match summary is highly recommended in the event of a dispute over the results. If one Team disputes the outcome of a Match indicating that it has won and if it provides proof constituting a serious body of evidence of its dispute, the other Team must also provide proof constituting a serious body of evidence of its victory to prevent the Match being automatically forfeited. Any team or player providing false or rigged results will be permanently banned from the Tournament and future Tournaments. Dacia will be solely responsible for determining the Winning Team in the event of a team dispute based on proof constituting a serious body of evidence provided by the relevant Teams. In any event, Dacia may replay the Match, under the control of an Administrator of the Tournament.
3.2.6 "Guest" accounts
Players will not be able to participate in the Tournament with "guest" accounts. All participants must have a unique and valid identifier on the Steam, Epic Games Store, Microsoft® Account, Nintendo Account or PlayStationTM Network, as well as appropriate levels of access to the Steam, Epic Games Store, Xbox LiveTM, NintendoTM Network or PlayStationTM Network, where applicable and agree to abide by the rules associated with these networks which are an integral part of these Rules
3.2.7 Spectators
Spectators are not allowed during the game except for the Tournament Administrators.
3.2.8 Invited Teams
Eight Invited Teams will join the Tournament from the main event. Invitations will be sent to eight Professional Teams operating in eligible regions. The list of Invited Teams will be composed at the discretion of the Tournament Administrators.
3.2.9 Dissemination
Players are allowed to broadcast their participation during the qualification stage but not during the main event. The main event matches will be broadcasted exclusively by Rocket Baguette. Any derogation from this agreement may lead to the disqualification of the team initiating the broadcast at the discretion of Dacia.
3.2.10 Bugs and incidents
In the event of a bug or incident having an impact on playability (gameplay), the entire Match must be replayed. If a Team requests that a Match be replayed due to bugs or incidents, it must save the summary and forward it to the Tournament Administrator for verification.
3.3 List of players registered on the Match sheet:
3.3.1 Formation of teams:
Each Team must declare one of the members of its list of registered players as a "Team Captain" to represent the Team for all official decisions and to act as a principal referent for its Team.
3.3.2 List of players registered for the Tournament:
Teams may only use Players who are registered for the Tournament. The list of registered Tournament Players must contain at least three Players and one designated Reserve Player who may be used if necessary. The list of Players registered for the Tournament must also include a manager who will not take part in the Tournament Games. The same Player cannot be registered in several Teams.
3.3.3 Communication of the list of players registered for the Tournament
The composition of the Teams at the beginning of each Match must be communicated to the Tournament Administrators at least twenty-four (24) hours before said Match.
3.3.4 Period of modification of the list of registered players/deadline for registration on the lists
Unless otherwise stated in these Rules, the lists of Players registered for the Tournament may not change during the Open Qualifications or the Main Event. All Player/Team lists are locked at the close of registration. To participate in each game, a Team must consist of three (3) Players. Otherwise, the Team concerned will be deemed to have forfeited on the part concerned.
3.3.5 Transfers
No transfer of one or more Player(s) from one Team to another Team is permitted at any time during the Tournament.
3.3.6 Player or Team Identifiers
Players or Teams are not allowed to change their Identifier (username, name in the Game, or team name, etc.) without the agreement of the Tournament Administrators. Said Identifiers must comply with these Rules and Tournament Administrators may request that they be amended at any time. The list of Registered Players provided by the Teams must not contain several times the same Identifier, Identifiers consisting only of symbols, or names that are difficult to distinguish from one another.
3.4 Match obligations
3.4.1 Punctuality
All Teams must have three players present physically or in the online Game Room, as well as in the designated chat room twenty minutes before the start of the Game. Teams that do not have three players ready to play within ten minutes of the start of the Match will be subject to sanctions or even disqualification from the Match.
3.4.2 Forfeiting
Teams are not permitted to voluntarily forfeit without the prior permission of the Tournament Administrators.
3.4.3 Communications
Teams will be able to communicate with their opponents and the Tournament Administrators in a dedicated chat room during all online stages of the Tournament. For live broadcast events, once the Match has officially started, any communication with anyone not designated as Players participating in the current Match is strictly prohibited and may result in immediate disqualification of the player(s) or the Team.
3.5 Match interruptions
3.5.1 Disconnections
3.5.1.1 Qualification stage:
If a Player disconnects during the qualification stage, the aggrieved Team may continue to participate in the current series of Matches. The disconnected player may return to the game in which the disconnection occurred or between two games in a series of Matches, but may not resume a Game in progress. After a disconnect, if the Player cannot return during the same game, they will have five minutes to reconnect before the start of the next game of the Match series. If the disconnected player is unable to return to the game before the next part of the series, then the player's Team may replace them with another player on its list if this is the first time the Team has disconnected during the series.
3.5.1.2 Main event
In the event of disconnection during any stage of the Tournament, except for the qualification stage, the aggrieved Team must immediately notify the Tournament Administrators via the game's chat. Tournament Administrators may decide to pause the game once they have received the logout notification, at their sole discretion. Once the game is paused, the disconnected Player will have five minutes to reconnect before the game resumes. If the player is unable to reconnect within the specified time, the aggrieved Team may continue to participate in the relevant game during the Match series. If the Player does not reconnect during the same game from which they were disconnected, they will have three additional minutes after the game to reconnect before the start of the next game of the Match series. The disconnected Player may only return to the game in which the disconnection occurred or between two games in a series of Games, but may not resume the Game in any subsequent game in the series. If the disconnected Player is unable to return to the game prior to the next part of the series, then the player's Team may replace the disconnected Player with another Player from its list (subject to the Replacement Rules set out in Section 3.2.4). For Matches played in the presence of an audience, if Tournament Administrators become aware that a player has been disconnected without being informed, they have the opportunity to pause a Game to allow the Player to reconnect. Each Team is entitled to a maximum break per Match. Once the disconnected Player joins the game or the time allotted for reconnection expires, the Teams have 30 seconds to confirm with the Tournament Administrators that each of them is ready to resume. Once each of them has confirmed that they are ready, the game will resume with a neutral commitment.
3.5.2 Game stoppage
Tournament Administrators have the opportunity to pause a game or a Match at any time and for any reason. In the event of a Game stoppage, Players must remain in front of their device and must not communicate with third parties and/or Players of another Team until the Match or the game is resumed.
3.5.3 Matches/games to be replayed
Tournament Administrators may decide to replay a Match or a game in certain exceptional circumstances, such as in the event that a bug would significantly affect a Player's ability to play, or if the Match or game is interrupted by a force majeure or another event.
4.1 Tournament prize
The Winning Team will win a cash prize of €15,000, up to a maximum of €5,000 per Winning Team Player. If a winner lives in a country whose currency is not the euro, then the sum will be converted into the currency of his country on the day of his designation. Each player on the Winning Team will also have the opportunity to complete a free and exceptional 4-week trial of the Dacia Spring in the countries where the Dacia Spring is marketed. List of eligible countries: France, Germany, Austria, Belgium, Bulgaria, Croatia, Denmark, Spain, Holland, Hungary, Italy, Poland, Portugal, Czech Republic, Romania, Slovenia, Slovakia, Switzerland.
4.2 Information about the Prize
From the date on which the official notification of Dacia is sent by email, each Player of the Winning Team shall have forty-five (45) days to reply and provide any information or document requested by Dacia, for the purpose of verifying its eligibility in accordance with Section 5, and an email belonging to this Player. This response from each relevant Player of the Winning Team must be returned to the email address that sent the official notification from Dacia or, at Dacia's sole discretion, to another email address specified in the notification. A copy of an identity document, national identity card or passport, and a proof of domicile will be requested. The total amount of the endowment is placed under sequestration at the bailiff's office of SCP SIMONIN – LE MAREC – GUERRIER, custodian of the settlement of the operation until the end of the tournament and the designation of the winning team. SCP SIMONIN – LE MAREC – GUERRIER is also mandated to pay the endowments to each member of the winning team in consultation with Dacia and any other service provider designated by Dacia. Dacia may send to each Player of the Winning Team any useful information relating to the awarding of the Prize. Dacia may transmit in the manner described in the preceding paragraph the monetary gain for each player within a limit of 3 to 6 months. The exceptional trial of the Dacia Spring is valid for 1 year, subject to the validation of the dates by Dacia. If the required information is not transmitted within the time limits provided for in the Rules and/or communicated by Dacia, the Player and/or the Winning Team will be deemed to have refused the Prize. Failure by such Player or Team to respond in a timely manner to any notification or request for any document or information shall result in such Player and/or Team being disqualified and such Player and/or Team shall therefore not be entitled to win any Prize in connection with the Tournament. In such cases, no other Player and/or other Winning Team will be nominated and Dacia will have the right, in its sole and absolute discretion, (a) to award any Prize to a Disqualified Player and/or Team or (b) to award all or part of the Prize to charities and charitable associations. The Winning Player (individually referred to as a "Winning Player" and in the case of a Team, a "Winning Team") will only be announced once the eligibility verification process has been finalised by Dacia in accordance with these Rules. Winning Players/Teams will also be required to provide certain payment information to Dacia, including tax information, in order to receive the Prize. Dacia may block the award of the Prize if the Player and/or the Winning Team is unable to submit the required information within the required time. Dacia will ask for the driver's license as well as an ID document to prove that the winners are indeed of age. Each Player shall be fully liable for any tax which may be imposed on them by reason of their acceptance of all or part of the Prize and shall not hold Dacia responsible in this regard. The 4-week free trial of Dacia Spring vehicles will take place as follows:
5.1 Age of Players
5.1.1 Players must be at least 18 years old to participate in the Tournament.
5.1.2 Ineligible Players who deceive or attempt to deceive Tournament Administrators by providing erroneous eligibility information will be subject to disciplinary action, as further described in Section 8.2.
5.2 Rocket League End User License Agreement (EULA)
5.2.1 Each Player is required to comply with the Psyonix Terms of Use (https://www.psyonix.com/tou/) and/or the Rocket League EULA (https://www.psyonix.com/eula/C:\Users\JERSUJ\AppData\Local\Microsoft\Windows\INetCache\Content.Outlook\O2623WDV\http s:\www.psyonix.com\eula\). These Rules supplement and do not replace the Rocket League EULA and Dacia shall not be responsible for the application or non-application of these rules.
5.2.2 Each Player is required to follow the Toornament Terms of Use https://www.toornament.com/bundles/frontapp/pdf/TOORNAMENT-CGU-27042021.pdf?1643725299. These Rules supplement and do not replace Toornament's Terms of Use and Dacia shall not be responsible for the application or non-application of Toornament's Terms of Use.
5.3 Affiliation with Dacia
5.3.1 Employees, directors, administrators, agents and representatives of Dacia's brand marketing and communication department and their immediate family members defined as spouse, mother, father, sisters, brothers, sons, daughters, uncles, aunts, nephews, nieces, grandparents and in-laws, regardless of where they live), as well as persons or entities associated with the production or administration of the Tournament (including any Dacia subcontractors and subsequent subcontractors) are not eligible to be Players and win the endowment.
5.4 Restrictions on Identifiers of Teams, Players, on logos, avatars and brands
5.4.1 In particular, all Identifiers of Teams and Individual Players must comply with the Code of Conduct defined in Section 7. Dacia and the Tournament Administrators may independently restrict or modify the Identifiers and/or slogans of the Team or the Players or the Identifiers appearing on the screen, for a reasonable reason and in particular an infringement of any right of a third party or adversely affecting the morals or image of Dacia or Psyonix.
5.4.2 The Identifier(s) used by a Team or Player may not contain or use the terms Rocket League®, Psyonix or any other trademark, trademark or logo owned or licensed by Psyonix, Dacia or any other trademark, trademark or logo owned or licensed by the Renault Group and, in general, may not infringe the rights of third parties or the morals or image of Dacia or Psyonix.
5.4.3 Prior to the start of the Tournament, Dacia and/or the Tournament Administrators will liaise directly with all Players to determine an acceptable Identifier for use in connection with the Tournament. Players and Teams must use this agreed Identifier throughout the duration of the Tournament without the validation of Dacia being considered as a legal guarantee of any kind. The Players and Teams remain in any event fully responsible for the Identifier they choose.
5.4.4 Qualified Teams must provide the Tournament Administrators with a logo in .png, .psd or .ai format (the latter is highly recommended). If the logo is not provided, or if it is refused, the Tournament Administrators will replace the logo with a standard Tournament logo. Tournament Administrators reserve the right to reject the logos submitted at any time and for any reasonable reason and breach of the terms of these Rules.
5.4.5 Dacia and/or Psyonix is/are the owner(s) or the dealer(s) of the intellectual property rights of both the general structure of the Game and/or the Tournament and its content (texts, slogans, graphics, images, videos, photos, programs and other content). Consequently, any representation, reproduction, modification, distortion and/or total or partial exploitation of the Game and/or the Tournament, by any process whatsoever and on any medium whatsoever, without the express and prior authorisation of Dacia, is prohibited and constitutes acts of copyright infringement.
5.4.6 Similarly, any unauthorised exploitation of the Game and/or the Tournament incurs the Player's criminal and civil liability on the basis of copyright infringement.
5.4.7 The Player acknowledges and accepts that access to the Game and/or the Tournament made available by Dacia may not entail any assignment or concession of the intellectual property rights (copyright in particular) and other personality rights (image rights, privacy rights) for the benefit of the Player.
5.4.8 Access to the Game and/or the Tournament is exclusively limited to the private and personal use of the Player.
5.4.9 The trademarks, logos, corporate names, acronyms, trade names, brands and/or domain names of Dacia and/or Psyonix and/or their business partners mentioned on the Game and/or the Tournament, constitute distinctive signs that cannot be used without the express and prior authorisation of their holder.
5.4.10 Any representation and/or reproduction and/or partial or total exploitation of these distinctive signs is therefore prohibited and constitutes trademark infringement, corporate name spoofing, trade name and domain name involving the tort liability of its author.
5.4.11 The hypertext links accessible on the Game and/or the Tournament, to other websites and in general to any existing resources on the Internet cannot engage the responsibility of Dacia.
5.4.12 The Player may not, under any circumstances, set up hyperlinks to the Player's and/or the Tournament's deep pages, allowing access to the Game and/or the Tournament, by any technical method intended to bypass the Player's identification field or to flush all or part of the content made available by Dacia.
5.5 Good compliance
Players /Teams must have paid or served any old penalties related to a breach of the Official Psyonix Rules.
5.6 Other restrictions
The Tournament is open in its entirety to Players who reside in Eligible Regions, but not valid in case of restriction or prohibition by local law.
6.1 The Tournament is composed entirely of Teams. The Players must come together to form a Team of three Players and possibly one substitute.
6.1.1 In the event that the Eligible Region consists of more than one country or geographical region, each Team must be composed of Players from the same region included in the Eligible Region.
6.1.2 Players can only play in one Team throughout the Tournament.
6.1.3 Each of the Team Players must meet all the eligibility requirements set out herein and the Team Player must register on the dedicated Tournament Registration website in order to be considered a member of the Team in question. During the Tournament registration process, one of the members of each Team must create/register the Team ID and the Players can join the Team by searching for the Team ID or by invitation. In the event that a Team passes the various rounds of the Tournament, the organisers of the Tournament will try to notify the Team via the "Team Captain" (as defined in Section 3.3.1).
6.1.4 Each Team Player, including the Team Captain, is deemed to have jointly and severally established and accepted all representations, warranties and agreements contained herein and shall be jointly and severally bound and liable by them. Except as otherwise expressly provided herein, all the rights of Tournament Administrators under these Rules may be exercised with respect to the Team as a whole and to each of the Players. If a right of disqualification applies to a Team Player, that right may be exercised with respect to that Team Player or the Team as a whole, at the sole discretion of the Tournament Administrators. If the Tournament Administrators decide to disqualify only certain Players of a Team, then the other Players will continue to be bound by these Rules and if permitted, at the sole discretion of the Tournament Administrators, the Team may replace the disqualified Player(s) (even if the disqualified Player was the Team Captain) with a new Eligible Player and continue the competition under the same Team Identifier if each disqualified Player promptly signs any document deemed necessary by the Tournament Administrators to allow their former team mates to continue the Tournament under the Team Identifier, or under another Identifier if permitted by the Tournament Administrators, at their sole discretion. Any Player of a Team who decides to terminate their participation in the Tournament and/or who is disqualified from the Tournament, will not be allowed to participate in the Tournament, regardless of their role, at the sole discretion of the Tournament administrator.
6.2 Relationships within the Teams
The Rules do not govern relationships within the Teams. The terms of the relationship between the Players and their respective Teams are left to each of the Teams and its Players. However, any dispute between Players of a Team may constitute grounds for disqualification of the Team in question or of any of its members, as decided by the Directors of the Tournament in their sole discretion.
6.3 Team owners
6.3.1 No owner or manager of a Team, or if the Team is owned by a legal person, no parent company, branch or subsidiary of said legal person, may directly (by ownership) or indirectly (by contractual provisions) own or control more than one Team within the Eligible Regions.
6.3.2 Teams that Dacia, in its sole discretion, deems to be directly or indirectly owned or controlled by a natural or legal person operating sports betting platforms or sites (including e-sports), will not be allowed to participate in the Tournament.
7.1 Personal conduct; Prohibited toxic behaviours
7.1.1 All Players shall at all times behave in accordance with (a) the code of conduct in this Section 7 (the "Code of Conduct") and (b) the general principles of personal integrity, honesty and sportsmanship behaviour.
7.1.2 Players should be respectful of other Players, Tournament Administrators and fans.
7.1.3 Players must not behave in a manner that (a) contravenes these Rules, (b) is intrusive, disruptive or destructive or (c) spoils for other users/Players the enjoyment of the game as desired by Dacia (according to the determination of Dacia).
7.1.4 By accessing the Game and the Tournament, the Player represents, warrants and undertakes to access and use the Game and/or Tournament in good faith, in a reasonable manner, not contrary to the terms of these Rules;
7.1.5 By entering the Game and the Tournament, the Player represents, warrants and undertakes to:
(above and below a "Toxic Behaviour").
7.1.6 In the event of a violation of these Rules, the Player shall be subject to disciplinary action as described in Section 8.2, whether or not such violation occurred intentionally.
7.1.7 In the event of a breach of any of these Rules, the Player is informed that Dacia will have the right to refuse or suspend, unilaterally and without prior notification, access to all or part of the Game and/or the Tournament and/or a Match and to suspend, if applicable, access to their account.
7.1.8 The Player agrees and acknowledges that Dacia cannot guarantee in particular:
7.1.9 The Player accepts without reservation that if the liability of Dacia were to be incurred directly or indirectly in its capacity as technical intermediary, by any person or entity whatsoever, Dacia reserves the right to take, promptly and automatically, any administrative and/or technical measure, including with regard to the Player allowing their interests to be safeguarded and/or to comply with the obligations incumbent on them.
7.2 Competition integrity
7.2.1 Each Player agrees to play at their best level in all circumstances during a Match. Any form of unfair play is prohibited by these Rules and may lead to disciplinary action. Examples of unfair play include:
● Collusion (such as an agreement between several Teams or Players of different Teams to decide in advance the outcome of a Match or Game, for example), the arrangement of a Match, the payment of bribes to a referee or manager of the Match, or any other action or agreement to voluntarily influence (or attempt to influence) the outcome of a Match or Tournament.
● The hacking or modification of the expected behaviour of the client of the Game.
● Playing or allowing another Player to play on a Psyonix account registered under another Identifier (or asking, encouraging or instructing someone to do so).
● The use of any device, program or other means of cheating in order to obtain an advantage during the competition.
● The intentional exploitation of a function of the Game (e.g. a bug or malfunction in the Game) in a manner not desired by Dacia, in order to take advantage of it during the competition.
● The use of denial-of-service attacks or other similar attacks to interfere with another Player's connection to the game's client.
● The use of macro keys or other similar methods to automate certain actions in the Game.
● Voluntary disconnection from a Match without reasonable cause.
● Accepting a gift, reward, bribe or payment for the promise of services evoked, rendered or to be rendered in connection with unfair behaviour during the Game (e.g., services designed to influence or arrange a Match or a session).
● Interfering with the conduct of the Tournament, with the website dedicated to the Rules or any website owned or operated by Dacia or the Tournament Administrators.
● Participating in any illegal activity in the jurisdiction in which the affected Player is located.
● Betting or wagering on your own performance, on the performance of your Team or on the results of the Tournament or any stage of the Tournament.
● Making any modification of the game that has not been declared to, or authorised by, the organisers of the Tournament.
● Using the facilities of the Tournament, services or equipment provided or made available by the organisers of the Tournament to publish, transmit, broadcast or make available any communication prohibited by this code of conduct.
● Disconnecting from the Gaming platform before being excluded by the Tournament Administrators.
● Changing the Player during the game or the Identifier including to take an Identifier from another Player.
● Violating these Rules in any other way.
7.2.2 Each Player agrees to play at its highest level in all circumstances during the Games and in accordance with the Rules set in Sections 7.1 and 7.2.
7.3 Harassment
7.3.1 Players are prohibited from engaging in any defamatory, abusive or discriminatory behaviour based on race, colour, ethnicity, national origin, religion, political opinions or opinions in general, sex, sexual identity, sexual orientation, age, disability or any other status or characteristic that the applicable law protects.
7.3.2 Any Player, witness or victim of defamatory, abusive or discriminatory conduct must inform one of the Tournament Administrators. All complaints filed will be investigated and appropriate disciplinary action may be taken. Any act of retaliation against a Player making a complaint or cooperating with the investigation arising from a complaint shall be prohibited.
7.4 Confidentiality
A Player is not permitted to disclose to a third party any confidential information transmitted by the Tournament Administrators, Dacia or its affiliates about Rocket League, the Tournament, Dacia or its affiliates, by any method of communication whatsoever, including through messages on social networks.
7.5 Illegal conduct
Players have the obligation to comply in all circumstances with the laws in force.
8.1 Investigation and compliance
8.1.1 The Players agree to cooperate fully with Dacia and/or the Tournament Administrator (as applicable) in the event of an investigation into potential violations of these Rules. If Dacia and/or any of the Tournament Administrators contacts a Player to discuss the investigation, the Player must be honest with respect to the information they provide to Dacia and/or the Tournament Administrator. Any Player found guilty of destroying or altering any useful information, or misleading Dacia and/or any of the Tournament Administrators during an investigation, will be subject to disciplinary action, as further described in Section 8.2.
8.1.2 The Players understand and agree that Dacia has the right, in its sole discretion, to withdraw a Player from or limit its participation in any Tournament event in connection with any investigation conducted by Dacia and/or a Tournament Administrator (as applicable) in accordance with Section 8.1.1.
8.2 Disciplinary action
8.2.1 If Dacia orders that a Player has breached the Code, or any other provision of the Rules, Dacia may take the following disciplinary action (as the case may be):
● Match to be replayed;
● Loss of the game and/or the Match;
● Forfeiting:
● Issuance of a private or public warning (verbal or written) to the Player;
● Loss of all or part of the Prize awarded to the Player;
● Disqualification of the Player for one or more Tournament Match(s) and/or sessions;
● Disqualification of the Player and/or the Tournament Team or
● Disqualification of the Player for one or more competitions organised, including in the future, by Dacia.
8.2.2 For the sake of clarity, the nature and extent of the disciplinary action taken by Dacia pursuant to this Section 8.2 shall be assessed at Dacia's sole and absolute discretion. Dacia reserves the right to claim damages and other remedies from this Player to the fullest extent permitted by applicable law.
8.2.3 If Dacia determines that a Player has committed repeated violations of these Rules, it may increase the severity of the disciplinary action, which may extend to the final exclusion of any Rocket League competition organised by Dacia thereafter. Psyonix may also apply the applicable sanctions set out in the Psyonix Terms of Use (https://www.psyonix.com/tou/) and/or the Rocket League EULA (https://www.psyonix.com/eula/) and/or the Toornament Platform Terms of Use (https://www.toornament.com/bundles/frontapp/pdf/TOORNAMENT-CGU-27042021.pdf?1643725299).
8.2.4 Any final decision issued by Dacia in the context of a disciplinary measure shall be final and enforceable for all Players and not subject to any appeal.
8.3 Rules disputes
Dacia represents the authority having the final and irrevocable decision concerning any dispute of all or part of these Rules, in particular in the event of a breach, application or interpretation hereof.
The Tournament is subject to these Rules. By entering, each Player agrees to: (a) subscribe to all of these Rules (including the Code of Conduct) and Dacia's decisions which are deemed final and enforceable; and (b) waive any right to plead the ambiguity of the Tournament or these Rules, unless otherwise provided by applicable law. By accepting a Prize, the Winning Player agrees to release Dacia from any liability, loss or damage arising out of or in connection with the award, receipt and/or use or misuse of the Prize or participation in any activity related to the Prize. Dacia cannot be held liable in the event of: (i) problem with a telephone system, telephone, computer hardware, software or any other technical or computer malfunction, lost connections, disconnections, delays or transmission errors; (ii) data corruption, theft, destruction, unauthorised access to or modification of registration or other items; (iii) injury, loss or damage of any kind, including death caused by the Prize or resulting from acceptance, possession or use of a Prize or participation in the Tournament; or (iv) any printing, typographical, administrative or technological error on the materials associated with the Tournament. Dacia reserves the right to cancel or suspend the Tournament in its sole discretion or due to circumstances beyond its control, including natural disasters. Dacia may prohibit any Player from participating in the Tournament or winning a Prize if it determines, in its sole discretion, that such Player is attempting to discredit the legitimate operation of the Tournament by fraud, hacking, deceiving or engaging in any other unfair gambling practice aimed at embarrassing, insulting, threatening, discrediting or harassing any other Player or representative of Dacia.
The French law governs disputes associated with these Rules and/or the Tournament. Dacia reserves the right, in its sole discretion, to cancel, modify or suspend the Tournament if a virus, bug, computer problem, unauthorised intervention or any other cause beyond Dacia's control corrupts the administration, security or proper conduct of the Tournament. Any attempt to deliberately harm or discredit the legitimate operation of the Tournament may constitute a violation of criminal and civil laws and will result in a prohibition to participate in the Tournament. Should such a case arise, Dacia reserves the right to seek and obtain compensation (including attorneys' fees) to the fullest extent provided by law, including the right to institute criminal proceedings. Dacia reserves the right to disqualify any Player who alters the registration process or the conduct of the Tournament or who violates these Rules.
10.1 The Player is solely responsible for their use of the Game and/or the Tournament.
10.2 Dacia may not be held liable in any proceedings brought against a Player who is guilty of improper use of the Game and/or the Tournament.
10.3 The Player acknowledges and agrees in this regard that they shall be personally responsible for any claim or proceeding brought against Dacia, due to the non-compliant use by them of the Game and/or the Tournament.
10.4 The Game may contain hypertext links to third-party websites.
10.5 In this regard, in view of the evanescent nature of the content that can be disseminated on the websites to which said hypertext links point, Dacia cannot be held liable in the event that the content of said websites of third parties contravenes the legal and/or regulatory provisions in force.
10.6 In any event, Dacia shall not be liable for:
10.7 Dacia shall not be liable for any malfunction of any nature whatsoever relating to the Player's computer equipment as well as its Internet access connection, when accessing the Game and/or the Tournament.
10.8 More particularly, Dacia cannot guarantee the Player on the problems of speeds of access to the Game and/or the Tournament and/or speed of buffering of the Player's equipment that the Player may encounter.
10.9 Correspondences exchanged between a Player and the Team are mainly provided by email or through the Game
10.10 Each Player acknowledges and agrees that the information delivered by Dacia by email and/or by the Game are valid between them and Dacia.
10.11 Elements such as the time of receipt or transmission, as well as the quality of the data received, will be authentic by priority as appearing on the aforementioned media, or as authenticated by Dacia's computerised procedures, unless they are proven in writing and to the contrary by the Player.
10.11 The scope of proof of the information delivered by the Game is that granted to an original within the meaning of a paper document, signed in a handwritten manner.
Dacia reserves the right to use the Identifier, name, slogan, portrait, video, Game stats and/or Psyonix account ID of any Participating Player for public purposes before, during or after the event end date, regardless of media type, anywhere in the world, at ten years, but only in connection with the Tournament promotion, without compensation or prior control, unless otherwise provided by law.
Dacia collects and processes personal data in accordance with Dacia's personal data policy available at https://daciabrandplatform.com/home/personal-data/. Our personal data is processed by Renault SAS, as a data controller.The processing of the personal data of participants is necessary for DACIA, data controller, as part of the proper management of the Tournament and in order to inform the winners of the results and send them their Prize in accordance with these rules certified by the bailiff's office of SIMONIN – LE MAREC – GUERRIER. This data will be shared with the service providers and subcontractors of DACIA, Rocket Baguette, Rocket League, Toornament, Swipe Back, acting on its behalf, on its instructions and control for the purpose of carrying out all or part of the processing of the personal data of the participants.The data of participants who are not designated as winners will be kept for the duration of the Tournament.Accounting data shall be kept for 1 year from the date of publication of the documentsTournament participants may access, update, modify, delete, transfer, restrict or object to the processing of their personal data and formulate post-mortem guidelines in this regard. In the event of a dispute that may arise in connection with these Rules, their interpretation and consequences or with the acts supplementing or modifying them, the Player will approach Dacia for the purpose of seeking an amicable solution. Any complaint to Dacia must be made in writing. In the absence of an amicable settlement, the Player may choose:
1) To resort to an amicable mediation solution within a maximum of one (1) year from its written complaint made by the Player to Dacia by seizing, (i) either by using the mediator of Dacia whose contact details are as follows Renault SAS, Legal Department, mailto:dpa@renault.comdpa@renault.com (ii) or by using the online dispute resolution system accessible at the following address: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguagehttps://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage, it being specified that the proposed mediation process cannot be a prerequisite for a referral to the competent courts for the Player.
2) To bring its claim before the competent French courts. TO THE FULLEST EXTENT PERMITTED BY LAW, IN THE EVENT OF A DISPUTE RELATING TO THE TOURNAMENT, THE INTERPRETATION, VALIDITY AND EXECUTION OF THESE RULES., AND FAILING AMICABLE AGREEMENT BETWEEN THE PARTIES, EXPRESS JURISDICTION IS GIVEN TO THE COMPETENT COURTS WITHIN THE JURISDICTION OF THE COURT OF APPEAL OF PARIS.
1. Pořadatelem facebookové soutěže značky Dacia je společnost Renault Česká republika, a.s., se sídlem v Pobřežní 620/3, Karlín, 186 00 Praha 8, IČ 601 92 801, zapsaná v OR vedeném Městským soudem v Praze, Spisová značka: B 2277 (dále jen “pořadatel)”.
2. Soutěž není žádným způsobem provozována, sponzorována nebo spojena s Facebookem a Facebook za ni neručí. Informace poskytnuté v rámci soutěže poskytujete pořadateli, nikoli Facebooku. Všechny dotazy, komentáře nebo stížnosti ohledně soutěže musí být směřovány pořadateli či organizátorovi soutěže, nikoliv Facebooku.
3. Účastníkem soutěže se může stát fyzická osoba s doručovací adresou na území České republiky, která akceptuje tato pravidla soutěže. Soutěže se nemohou zúčastnit osoby, které jsou v pracovním nebo obdobném poměru k pořadateli a společnostem, které se podílejí na přípravě a organizaci soutěže.
4. Soutěžit je možné v období od 10. 12. 2021 do 22. 12. 2021 do 14:00. Soutěž probíhá na fanpage Dacia CZ na adrese https://www.facebook.com/Dacia.CZE . Soutěžící se do soutěže zapojí správnou odpovědí na hádanku v animaci soutěžního příspěvku. Zapojením se do soutěže souhlasí soutěžící s pravidly této soutěže. Každý soutěžící může vložit pouze jeden komentář během doby konání soutěže.
5. Soutěžící se zapojí do soutěže správnou odpovědí hádanku v soutěžním příspěvku, ta zní – “Který model máme na mysli?”. Komentář nesmí obsahovat žádné vulgarismy ani slovní útoky na pořadatele a nesmí odporovat dobrým mravům.
6. Zástupce Pořadatele po skončení období vložení komentáře uvedeného v článku 4. výše vylosuje z komentářů pod soutěžním příspěvkem, vložených do konce období pro odevzdání odpovědi a vyhovujícím podmínkám uvedeným v bodě, jednoho výherce, kterému zapůjčíme vybraný model Dacia Spring na jeden týden. Soutěžící se mohou soutěže zúčastnit pouze jednou a vložit pouze jeden soutěžní komentář pod soutěžní post. V případě vložení více komentářů v soutěži soutěžícím bude započítán pouze první vložený komentář.
7. Výherce soutěže bude o výhře informován do 1 týdne od skončení soutěže pomocí komentáře pod soutěžní post. Za účelem zaslání výhry bude výherce požádán o zaslání kontaktních údajů (jméno, příjmení, adresa, e mail a telefonní číslo). Pokud výherce nedodá potřebné údaje do 24 hodin od vyhlášení výsledků, tak výhra propadá a ztrácí na ni nárok.
8. Výherci získávají výhry uvedené v bodě 6.
9. Na výhru nevzniká právní nárok.
10. V souvislosti s účastí v soutěži pořadatel tímto informuje o zpracování osobních údajů účastníků soutěže. Správce zpracovává osobní údaje v rozsahu jméno a příjmení účastníka soutěže, jméno a příjmení výherce, u výherců též adresa a tel. číslo, a to za účelem vylosování výherce a předání výhry. Osobní údaje jsou zpřístupněny zejména zaměstnancům pořadatele v souvislosti s plněním jejich pracovních povinností, pouze však v rozsahu, který je nezbytný a při dodržení veškerých bezpečnostních opatření. Výše uvedené osobní údaje bude Správce uchovávat po dobu trvání soutěže, včetně vylosování výherce a předání výhry.
11.Svou účastí v soutěži účastník soutěže souhlasí s tím, aby pořadatel, za výše uvedenými účely shromažďoval, zpracovával a uchovával osobní údaje účastníka soutěže v rozsahu jméno a příjmení účastníka soutěže, jméno a příjmení výherce, u výherců též adresa a tel. číslo, a to za účelem vylosování výherce a předání výhry. Účastník soutěže má právo odvolat svůj souhlas i v průběhu trvání soutěže, a to písemně na adrese: Renault Česká republika, a.s., se sídlem v Pobřežní 620/3, Karlín, 186 00 Praha 8
12. Pořadatel si vyhrazuje právo vyřadit ze soutěže ty soutěžící, kteří porušují pravidla, i při podezření na takové porušení. Rozhodnutí pořadatele je konečné.
13. Zasláním příspěvku do soutěže účastníci přijímají veškeré její podmínky. Rozhodnutí pořadatele o všech otázkách, týkajících se soutěže, je konečné. Pořadatel si vyhrazuje právo kdykoliv jednostranně změnit pravidla této soutěže, případně soutěž bez dalšího uvedení důvodu ukončit, přičemž jeho rozhodnutí je účinné okamžikem zveřejnění.
